TruVault Market is a New York–based online venue where verified users list and buy high-value pre-owned goods. TruVault Market is not the seller of any item and never takes custody of buyer or seller funds.
1. Who we are and what we do
TruVault Market is operated from Long Island, New York. We provide the venue, listing tools, messaging, escrow coordination and dispute support. Title to any item passes directly from the seller to the buyer.
You must be at least 18 years old and legally able to enter into contracts in New York to use the platform.
2. Eligibility, accounts and identity
Accounts are personal. You are responsible for activity under your account and for keeping your credentials secure. We may suspend accounts for fraud, misrepresentation of goods, non-delivery, harassment, or attempts to move a transaction off-platform to avoid escrow.
3. Seller obligations
Sellers must have lawful title to each item, describe condition accurately, disclose service history, aftermarket parts, replacement components, damage and missing box or papers, and use photographs of the actual item. Knowingly listing counterfeit or stolen goods is prohibited and may be reported to law enforcement.
Descriptions must not be deceptive under New York General Business Law §§ 349 and 350. We do not describe any item as "authenticated" unless an authentication process actually took place.
4. Buyer obligations
Buyers must fund escrow promptly, inspect the item during the 72-hour verification window, and either accept or open a dispute before that window closes. Failing to act within the verification window without an eligible dispute results in automatic release of funds to the seller.
5. Escrow and payment
Payment is handled by an independent third-party escrow provider. TruVault Market does not hold, transmit or take custody of funds and is not a money transmitter under New York Banking Law Article 13-B. The escrow provider's own agreement governs the holding and release of funds.
6. Fees
TruVault Market charges a flat $50 marketplace fee per completed sale, split evenly: $25 from the buyer at checkout and $25 from the seller's payout. The fee is earned only when escrow releases and the sale completes. Cancelled and refunded orders are never charged. Escrow provider fees and shipping charges are separate and set by those providers.
7. Sales tax
Sellers are responsible for setting accurate sales tax rates, maintaining tax registrations, and remitting any tax collected to the appropriate tax authorities. TruVault Market provides checkout tools that calculate and display tax based on the shipping destination and the rates configured by the seller or marketplace. New York deliveries are taxable as required by New York Tax Law § 1101(e); sellers should verify their obligations with a tax professional.
8. Disputes between users
Disputes over item condition or delivery are raised on the order page during the verification window and are resolved through the escrow provider's dispute process. TruVault Market may provide evidence, messaging records and shipping data to that process.
9. Disclaimers and limitation of liability
The platform is provided "as is." TruVault Market does not warrant the accuracy of user listings. Nothing in these terms limits liability that cannot be limited under New York law, including liability for fraud or willful misconduct. Where permitted, TruVault Market's aggregate liability arising from a transaction is limited to the marketplace fees we collected on that transaction.
10. Governing law and venue
These terms are governed by the laws of the State of New York without regard to conflict of laws rules. Any action must be brought in the state or federal courts located in Nassau or Suffolk County, New York, and both parties consent to that venue.
Consistent with New York General Obligations Law § 5-1401 and § 5-1402, disputes involving amounts of $250,000 or more may be brought in New York courts regardless of the parties' residence.
11. Changes
We will post material changes on this page and update the "last updated" date. Continued use after a change means acceptance of the revised terms.
